General Terms and Conditions of Cijferakkoorden.nl

General terms
1. Offer and agreement.
These terms and conditions apply to all orders for digital sheet music (PDF with chord charts or physical print) via cijferakkoorden.nl. By placing an order, the customer agrees to these terms and conditions. Cijferakkoorden.nl is a Dutch sole proprietorship located in Ridderkerk, South Holland. After the order is placed and payment is made, the purchase agreement is concluded.
2. Products.
The music pieces offered are digital files (PDF) or physically printed scores. There is no physical delivery for digital sheet music; the product is delivered digitally via email after successful payment, or by mail if it's a printed edition. The customer is responsible for providing a correct (email) address and proper technical reception (internet, software). Prices are in euros or in other currencies if visiting the website from a country other than the Netherlands, including VAT. Payment is made via iDEAL, processed by Mollie. We only share with Mollie the information strictly necessary for the payment (such as your name and bank account number). Cijferakkoorden.nl is not responsible for the payment transactions; Mollie handles the transaction.
3. Intellectual property.
All copyrights and other intellectual property rights to the digital products belong to Cijferakkoorden.nl. The customer receives only a non-exclusive, non-transferable right of use for personal, private use. Copying, sharing, or commercially exploiting the sheet music without permission is prohibited. Cijferakkoorden.nl guarantees that the files provided do not infringe on the rights of third parties.
4. Delivery and risk.
The digital product will be delivered via email immediately after payment. The risk for the file transfers to the customer once the product has been shipped. Any defects in receipt or incorrect use of the file are the customer's responsibility.
5. Right of withdrawal and returns.
For digital products (without a physical medium), no right of withdrawal applies – in accordance with Article 6:230p of the Dutch Civil Code – provided that delivery has begun with the consumer's express consent and the consumer has waived their right of withdrawal. By placing an order, the customer agrees to immediate delivery and waives their right of withdrawal. Return requests will therefore not be honored. An exception to this is a manifest error (e.g., a duplicate order): only after written confirmation (via email) can we consider a (partial) refund in consultation.
6. Price, payment and invoicing.
All prices on the website are in euros and include VAT. After checkout, the payment is final; the customer will receive an invoice by email. Payments via iDEAL are processed by Mollie. Cijferakkoorden.nl's customer service only sees your name and payment details (IBAN) if necessary. Mollie processes this information to process the payment. Cijferakkoorden.nl does not store any unnecessary payment information and will not share any other personal data without your permission.
7. Liability.
Cijferakkoorden.nl strives to provide error-free, high-quality sheet music, but cannot be held liable for any inaccuracies in the scores or their use. We accept no liability for damages resulting from the use of the supplied files. Delivery and correspondence are handled electronically; the customer is responsible for correctly configuring their email program and security software to receive messages. Furthermore, Cijferakkoorden.nl is not liable for indirect or consequential damages.
8. Complaints.
Complaints about the product or delivery can be submitted by email to service@cijferakkoorden.nl. We strive to handle complaints quickly and reach a solution amicably.
9. Force majeure and invalid provisions.
Cijferakkoorden.nl is not liable if it fails to fulfill its obligations due to circumstances beyond its control (e.g., force majeure). If any provision of these terms and conditions is deemed void or unenforceable, the remaining provisions will remain in full force and effect.
10. Applicable law.
This agreement is governed exclusively by Dutch law. Disputes will be submitted exclusively to the competent court in the Netherlands.
Privacy Statement
Cijferakkoorden.nl processes personal data in accordance with the GDPR. We collect only the data necessary to process your order and provide related services. Below are the key points:
Collected data:
When you place an order, Cijferakkoorden.nl processes your first and last name, email address, and payment information (for iDEAL, your bank account number) for invoicing, payment, and delivery of the product. Your email address is also used for (digital) communication regarding your order.
Payment details:
For iDEAL payments, we work with Mollie. Mollie processes your name and payment details (such as your bank account number) solely for the purpose of processing the payment. Cijferakkoorden.nl shares your personal data with Mollie only for this necessary purpose. No other personal data is shared with third parties, except as required by law or for the execution of the agreement.
Newsletter:
When you subscribe to our free email newsletter, we store your first name and email address to send you periodic information. You provide your consent for this separately. You can unsubscribe from the newsletter at any time via the unsubscribe link in every email. After you unsubscribe, we will remove your email address from our mailing list.
Retention period:
Personal data will not be retained longer than is strictly necessary for the purposes for which it was collected. Data required for (tax) invoicing will be retained in accordance with statutory retention periods (up to 7 years).
Your rights:
As a data subject, you have the right to access, correct, or delete your personal data. If you would like to know what data we hold about you or have it deleted, you can request this by emailing service@cijferakkoorden.nl. You can also withdraw your consent to the newsletter at any time by clicking the unsubscribe link or by sending us an email.
Safety:
We take appropriate technical and organizational measures to protect your data. Payments are processed through Mollie's secure platform, which complies with data protection requirements.
